By accessing this website and placing an order with Stacked Positivity LLC (“we,” “us,” “our”), you agree to be bound by the following Terms of Service. Please read these terms carefully before completing a purchase.
General Conditions
We reserve the right to refuse service to anyone for any reason at any time. By using this site, you confirm that you are legally able to enter into binding contracts and are authorized to use the payment method provided.
Products & Descriptions
All products are sold as described. Many items are handmade, small-batch, live-sale, or limited-quantity. Minor variations do not constitute defects.
Failure to read product descriptions, listings, or store policies does not exempt the customer from these Terms.
Order Processing & Shipping
Processing times are outlined in our Shipping Policy. Processing time is separate from shipping transit time.
Once an order has shipped, responsibility for the package transfers to the customer.
Stacked Positivity LLC is not responsible for carrier delays, lost packages, or delivery issues once tracking shows the order has shipped or been delivered.
All Sales Final / No Returns / No Refunds
All sales are final.
We do not accept returns and do not issue refunds under any circumstances.
By completing a purchase, the customer explicitly acknowledges and agrees that all purchases are non-refundable and non-returnable.
Damaged Items (Replacement Only)
If an item arrives damaged, the customer must contact Stacked Positivity LLC within 7 business days of the order being marked as delivered and provide all requested photo evidence and descriptions.
Replacement approval is at our sole discretion.
If approved:
 - A return shipping label will be provided via email
 - The item must be returned for inspection
 - A replacement will be sent only after inspection
If a replacement is unavailable, store credit only will be issued for the owed amount.
Refunds will not be issued.
Delivered but Not Received
If tracking shows an order as delivered but the package cannot be located, Stacked Positivity LLC is not responsible for replacement or refund. Customers must contact the shipping carrier directly.
Cancellations
     Advent Calendars
Advent Calendar purchases are final and cannot be canceled once placed.
     Subscriptions
If a customer cancels a subscription after payment for the current month:
 - No refund will be issued
 - The current month’s box will still be shipped
 - Cancellation applies only to future billing cycles
   Live Sale Purchases
Live sale purchases are binding commitments.
If a customer cancels before completing payment, the deposit is non-refundable and is retained as a cancellation fee.
Orders Canceled After Shipment
If a cancellation is requested after an order has shipped:
 - The customer must return the package at their own expense
 - The parcel must be unopened, unused, and untampered
 - All items must be present and undamaged
If inspection confirms compliance, cancellation will be approved.
If items are missing, damaged, or show signs of use or tampering:
 - The cancellation will be denied
 - No refund, credit, or reshipment will be issued
Cancellation Credits
Approved cancellations result in store credit only, equal to the invoice total minus any non-refundable deposit or cancellation fee.
Refunds are never issued.
Chargebacks & Payment Disputes
By placing an order, the customer agrees not to file a chargeback or payment dispute for reasons covered under these Terms or our policies, including but not limited to:
 - Processing times
 - Shipping delays
 - Delivered but not received claims
 - Buyer’s remorse
 - Failure to read store policies
Customers must contact Stacked Positivity LLC directly to attempt resolution before initiating a dispute. Policy documentation and evidence will be submitted to payment processors for any disputes filed in violation of these Terms.
Privacy Policy
Our Privacy Policy is automatically generated and maintained by Shopify and governs how personal information is collected, used, and disclosed. By using our Services, you agree to the Privacy Policy as posted on our website.
In the event of a conflict between these Terms and the Privacy Policy, the Privacy Policy governs matters related to personal data.
Limitation of Liability
Stacked Positivity LLC shall not be liable for any indirect, incidental, or consequential damages arising from the use of our products or services.
Changes to Terms
We reserve the right to update or modify these Terms at any time without prior notice. Changes take effect immediately upon posting.
